The Company makes available for testing purposes to Data TestLab and Data TestLab accepts the submitted Product(s) identified above for testing during the term specified. This Test Agreement is subject to these terms and conditions:

1. The Company bears all transport costs of the Products to and from Data TestLab or to and from the location specified by Data TestLab (e.g. our photo studio).
2. All products have to be fully and securely packaged. Data TestLab will not be held responsible for any damage resulting from transport to or from Data TestLab or to and from the location specified by Data TestLab.
3. The Product(s) is (are) insured by KBC Verzekeringen (Polis nr. AR/81.019.698.0000) for the duration of the test only if the Product(s) is (are) accompanied by a delivery note with a clear description of the Product(s) and if the serial number(s) is (are) filled-in on this Agreement. Products that do not meet these conditions are not insured. In case of mishap the franchise of 125 euro for insured products will be at the expense of The Company. Claims that are not covered by our insurance are at the expense of The Company. Data TestLab will never be held responsible for uninsured or underinsured Products. A copy of the insurance policy is available on simple request (but only in Dutch). The Company is advised to insure all submitted Products.
4. The Company will pick up the submitted Products by the Last Pick-up Date specified. The Last Pick-up Date is two months after the end of the agreed testing term. Products not picked up by this date automatically become the property of Data TestLab and DTL bvba.
5. Unless otherwise agreed in writing with Data TestLab (e.g. in the case of beta or preview products), The Company will only submit fully functional, consumer-ready Products for testing. Manuals and any necessary software (e.g. drivers) should accompany the submitted Products.
6. Submitted Products should be configured for use in Belgium if necessary. Data TestLab will not be held responsible for damage resulting from a lack to adhere to this test condition (e.g. wrong voltage).
7. This Agreement supersedes all other agreements that may exist between The Company and Data TestLab. It specifically supersedes any other Loan Agreements or Terms and Conditions of Loan or any other Agreement(s) that may exist between T 1159 he Company and Data TestLab.
8. This Agreement is terminated when the submitted Product(s) is (are) picked up by The Company or by the Last Pick-up date, whichever comes first.
9. In case of disagreement(s) between The Company and Data TestLab only the courts of the Arrondissement Turnhout in Belgium are authorised. Only the Belgian laws apply to this Agreement.
